Rafting, by its nature, is an inherently dangerous sport. Although Water by Nature will take every precaution to ensure your safety and enjoyment, please be aware that accidents can happen. Because much of the rafting experience occurs in remote locations, access to medical care can be limited. In addition, for these same reasons, there is always the possibility of a disruption of travel plans. These Terms and Conditions limit Water by Nature’s liability, and define your rights and obligations. Although they have been written by a lawyer, and are completely without humor, they are important: Please read them carefully.

How to book:
You can reserve your trip by contacting Water by Nature directly at the address or phone number indicated above, or you can book a trip through your travel agent. Water by Nature will confirm your reservation by issuing a confirmation number, which indicates our acceptance of your reservation.
At the time of reserving your trip, a £600 (USD$750) initial deposit is required (£750 (USD$1,000) in the case of the Cotahuasi, African Odyssey, Grand Canyon and New Zealand trips). This deposit is per person. At 190 days (or 250 days before in the case of Peru Cotahuasi, African Odyssey, New Zealand or Grand Canyon) or if the booking is made at less than 190 days (or 250 days for aforementioned trips) prior to the trip commencement, a payment of 50% of the remaining balance must be paid. The final remaining balance must be paid at least 100-days prior (Peru, Cotahuasi, African Odyssey, New Zealand, Grand Canyon 120 days before.) to the scheduled commencement date of the trip including extensions. If the balances are not paid within this time, Water by Nature reserves the right to cancel your booking without further notice to you. Bookings made within 100-days (or other specified time frames as set out above) of the departure date must be paid in full at the time of the booking. All bookings made from the U.S.A. must be paid in U.S. dollars for both the deposit and the balance. Due to the costs of cashing dollar cheques (checks) in the U.K. a surcharge of $70 will apply to all one-off payments by means of a U.S. dollar cheque. If you require special arrangements, please contact Water by Nature direct. Any special payment arrangements must be approved by Water by Nature in advance. Water By Nature accept Debit Cards, Mastercard, Visa and American Express cards. Please call your card details through and do not send them by e mail as this is not secure.
If you wish to cancel your trip, you must notify Water by Nature directly in writing. Any cancellation will be accepted as of the date of receipt by Water by Nature of your written notification.
Cancellation by client:
The following time frames govern Water by Nature’s obligation to refund any payments made by you for the rafting trip:
More than 100-days prior to departure Deposit not refunded;
All other payments refunded.
A note on Covid-19. If we are able to run the trip and you choose not to go, a refund/partial refund or credit note will FULLY be at Water By Natures discretion. Adequate insurance should be in place to protect you for this eventuality.
Less than 90-days prior to departure full payment not refunded;
Balance of payments refunded only if Water by Nature is able to re-sell your booking.
If you cancel your booking less than 100-days prior to departure, Water by Nature will make every reasonable effort to re-sell your booking. However, Water by Nature is under no obligation to take any extraordinary measures to try to fill your spot on the trip. You may, at your own expense, try to sell the booking yourself. In such a situation, Water by Nature will accept a transfer of your reservation subject to the following additional conditions:
you must notify Water by Nature no later than 21-days prior to the departure date of the transfer of your reservation;
the transferee must accept these Terms and Conditions;
you remain responsible for any outstanding payment obligations;
you are responsible for any additional payments that must be incurred by Water by Nature as a result of the transfer of your reservation;
the transferee is responsible for making any other arrangements necessary for their participation in the trip, including, but not limited to, obtaining any necessary travel authorizations, travel insurance covering medical evacuation or visas;
under no circumstances will Water by Nature be responsible for any problems caused as a result of the transfer of your reservation, including, but not limited to, disruptions in travel, payment arrangements made between you and the transferee, failure of transferee to obtain any necessary travel documents.
Alteration by Water by Nature:
Water by Nature makes arrangements for these trips many months in advance. As a result, Water by Nature must reserve the right to make alterations to the trip, both before and after booking (and in some cases, while actually on the trip). Most of these changes will be minor, and, in all cases, you will be advised at the earliest opportunity. If a significant change occurs, you will have the choice of either accepting the change, purchasing another trip from Water by Nature (if this involves a difference in price, you are responsible to pay any increase and Water by Nature will refund any decrease), or canceling your trip and receiving a full refund. A change in flight time, carrier, type of aircraft, or destination airport will not constitute a “significant” change. If a minor change occurs within 60-days of the departure date and results in additional expenses to you, Water by Nature will compensate you for any such reasonable expenses up to £30 per person. To claim such compensation, you must submit to Water by Nature receipts for such expenses within 14-days of the conclusion of your trip. No refunds or compensation will be payable for minor changes, and no claim for compensation or expenses will be accepted.
Sometimes changes to the trip may be caused by forces completely beyond Water by Nature’s control. Water by Nature does not accept responsibility for delays or cancellations caused by war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, fire, technical problems with transport, closure or congestion of airports or ports, adverse weather conditions, acts of God, and similar events beyond Water by Nature’s control.
Cancellation by Water by Nature:
We reserve the right to cancel your trip under any circumstances. However, in no cases will we cancel a trip less than 14-days prior to departure except for reasons outside our control, including, but not limited to, reasons such as those described in paragraph 7 above, your failure to pay all amounts due as detailed in these Terms and Conditions, or any other failure by you to comply with these Terms and Conditions. Water by Nature further reserves the right to cancel any trip within 14-days of the departure date if an insufficient number of people have booked your chosen trip, or if cancellations by other participants cannot be re-booked, thereby causing an insufficient number of people on the trip. Where we are forced to cancel a trip due to insufficient numbers, except in the case of failure to pay all amounts owed, you may choose to accept a full refund, or transfer your reservation to another trip offered by Water by Nature. In the event you choose to participate in another trip, you will be required to pay any difference in purchase price (if the amount of the second trip is greater than the first) or Water by Nature will refund any difference in price (if the cost of the second trip is less). All other Terms and Conditions will remain the same with regard to a new trip reservation. In very unusual situations, Water by Nature may be forced to cancel a trip after the departure date for reasons beyond our control as detailed in paragraph 7 above. In such situations, there can unfortunately be no refunds or compensation of any amount.
The prices of trips are subject to change. As a condition of your reservation, you agree to pay any change in the cost of the trip that is beyond Water by Nature’s control, up to 15% of the original price quoted to you. Any increase in the cost of a trip beyond 15% of the original price quoted to you will constitute a “substantial change” in the terms of the trip, thereby entitling you to those rights detailed in paragraph 6 above. If you choose to continue with the trip booked, you will be responsible for the increase in cost. Any such increase in cost payable by you must be paid within 14-days of notification to you of the increase, but in no event less than 10-days prior to the departure date. Examples of increased costs beyond the control of Water by Nature includes, but is not limited to, currency devaluation’s, increased costs of third party providers of services such as transportation and taxes.
Water by Nature takes every precaution to ensure the safety of all participants. However, by undertaking a trip with Water by Nature, you are assuming the risk of any injury, including death. To help in minimizing the risks to all involved, you are required to follow all instructions of Water by Nature employees and agents. Failure to follow any instructions or recommendations is at your own risk. Water by Nature, its employees and agents cannot be held responsible for any injury caused to you, or by you to others, resulting from your failure to follow an instruction(s) or recommendation(s). If your failure to follow any instruction(s) or recommendation(s) causes an increase in risk, or threatens the safety and enjoyment of others on the trip, Water by Nature reserves the right to take all reasonable steps to ensure the safety of the other participants, up to and including, immediate termination of your participation in the trip.
The activities you will be engaged in do often require a reasonable level of physical fitness and agility. Water by Nature reserves the right to reject your booking if your physical condition poses a potential threat to the safety of yourself or other participants or if Water By Nature deems it does not have the resources needed to accommodate your physical condition. If Water by Nature does proceed with a booking we may make an additional charge for services or resources needed to accommodate your physical condition. If you are unsure of your ability to participate, you should contact Water by Nature and/or speak with a physician prior to booking a trip. If you have already booked a trip and are subsequently unable to participate because of your physical condition, any change or cancellation to your trip is subject to the provisions otherwise detailed in these Terms and Conditions. Your failure to clear your ability to participate in the trip with Water by Nature, as detailed herein, and our subsequent determination that your condition poses a significant safety risk, shall not constitute a “substantial change” as defined in paragraph 6. If you require medications, you should ensure you take enough with you to last the trip. Any medication you take with you is your responsibility.
We believe that your safety and enjoyment when travelling overseas with us is very important. Please note: Adequate Travel Insurance is COMPULSORY for ALL trips, without exception. It must cover you for the grade of river you will be on, as well as medical evacuation and repatriation to your home country. The current Covid Crisis has highlighted the need to have comprehensive travel insurance in place. We strongly recommend you use reputable insurers who have specifically confirmed that they are including Covid or Coronavirus cover for both medical and cancellation. We have the right to refuse your Travel Insurance, given the remote nature of our trips, if we do not deem it suitable. Please check with us before purchasing your travel insurance to ensure it meets our requirements.We have arranged travel insurance with specialist Insurance Brokers Campbell Irvine, underwritten by the UK’s largest travel insurer, AXA Insurance (UK) plc*. The cover includes a 24-Hour Worldwide emergency Medical Service who are experts in providing friendly and professional emergency help in the unlikely event this is required. To arrange cover or to obtain a quotation, please contact Campbell Irvine or Global Rescue (USA guests).Your reservation of a trip with Water by Nature does not include insurance of any type. All types of insurance are your responsibility, and you are encouraged to obtain appropriate insurance for your personal belongings, trip cancellation by you due to an illness, injury or family bereavement, trip interruption, medical and legal expenses, and personal liability as you deem necessary. You should consult with a travel insurance professional prior to departure for the best type of insurance for your needs. Although we will take all steps to help you if you get into a difficult situation, Water by Nature cannot be held responsible for your failure to secure appropriate insurance. Medical evacuation and repatriation insurance as part of your travel insurance is COMPULSORY in the unlikely event you are hurt on the trip.
All luggage and personal effects are at all times your own responsibility.
Water by Nature will not be responsible for any loss, delay or costs connected with adverse weather conditions.
When you utilize other transportation, not under the direction or control of Water by Nature, the terms and conditions of carriage of that carrier shall apply, some of which will limit or exclude liability. Some conditions of carriage are governed by international agreements between countries.
Travel Regulation Insolvency Protection & Bonding
Water by Nature Rafting Journeys Ltd is a company committed to customer satisfaction and consumer financial protection. We are therefore pleased to announce that, at no extra cost to you, and in accordance with ” The Package Travel and Linked Travel Arrangements Regulations 2018” all passengers booking with Water by Nature Rafting Journeys Ltd are fully insured for the initial deposit, and subsequently the balance of monies paid as detailed in your booking confirmation form. The policy will also include repatriation if required, arising from the cancellation or curtailment of your travel arrangements due to the insolvency of Water by Nature Rafting Journeys Ltd. This insurance has been arranged by Towergate Travel through Zurich Insurance PLC. Claims: In the unlikely event of Insolvency, you must Inform Towergate Travel immediately on +44 (0) 1932 334140 or by email at firstname.lastname@example.org . Please ensure you retain the booking confirmation as evidence of cover and value. Policy exclusions: This policy will not cover any monies paid for Travel Insurance or any claim relating to Air Flights. If you have booked flights as part of your travel, you should ensure that the company with which you booked the flights has the appropriate CAA/ATOL bonds in place.
If you should miss any flight or other arranged transportation, thereby resulting in your inability to further participate in the trip, Water by Nature will not be responsible to refund any amounts to you or for additional costs incurred by you.
Photographs and Handycam/DVD Images.
You grant to Water By Nature, its representatives and employees the right to take photographs and images of you and your property in connection with Water By Nature’s adventure holidays. You authorize Water By Nature, its assigns and transferees to copyright, use and publish the same in print or promotional DVDs and/or electronically. You agree that Water By Nature, may use such photographs and images of me without my name and for any lawful purpose, including for example such purposes as publicity, illustration, advertising, and Web content. Not every trip will have images or DVD available for purchase.
Disputes with Water by Nature:
By making the reservation for a trip with Water by Nature, you agree to be bound by these Terms and Conditions.
These Terms and Conditions and any contract to which they apply are governed in all respects by English Law and they shall be subject to the exclusive jurisdiction of the courts of England.
If any part of these Terms and Conditions is determined by a court to be unenforceable, the remainder of the Terms and Conditions shall be unaffected and shall continue in full force and effect.
